Following Adalah's Petition: Haifa District Court Issues Temporary Injunction against Implementation of Regional Master Plan for Daliyat al-Carmel
(Haifa, Israel) On 6 September 2010, the Haifa District Court issued a temporary injunction ordering the Northern District Planning Committee and the National Council for Building and Planning not to begin implementation of the Regional Master Plan for Daliyat al-Carmel, an Arab Druze town located in the north of Israel. The court's interim decision follows a petition submitted by Adalah on behalf of 43 residents of Daliyat al-Carmel in March 2009. The implementation of the plan would lead to the demolition of 600 homes in the village. The petition was filed by Adalah Attorney Suhad Bishara and Urban and Regional Planner Hana Hamdan.
In the petition, Adalah demanded the cancellation of the master plan for the town and that an alternative plan be drafted in consultation with the residents of Daliyat al-Carmel. Adalah argued that the master plan would lead to the demolition of hundreds of homes belonging to Arab citizens of Israel, residents of Daliyat al-Carmel. In addition, Adalah argued that the plan fails to increase the jurisdictional area of the village or add any new areas zoned for construction, despite the natural population growth of the town over the years. The next court date is scheduled for January 2011.
